In 2015, Mayor Joel Fajardo and City Council of San Fernando first city in Southern California to recognize Indigenous Peoples Day. This year, on October 14, 2017, the City along with the Fernandeño Tataviam Band of Mission Indians are celebrating its 2nd Annual Indigenous Peoples Day Celebration in the beautiful City of San Fernando, on the village of Paséknga.
Indigenous Peoples Day celebrates the sovereignty, cultures, and lives of all indigenous peoples. The event will host songs and dances of Indigenous peoples of the Americas, as well as traditional storytelling. There will be indigenous food, drum circles, traditional games, arts and crafts workshops, educational booths, and interactive stations.

These agreement regulations are set forth by the Fernandeño Tataviam Band Mission Indians and Pukúu Cultural Community Services, collectively and hereinafter referred as the IPD Host.
Location.
(Hereinafter referred to as “Premises”)

Permits.
Vendor is responsible for obtaining all licenses and permits that are or may be required by any public authority for sale of any of the Products.
CITY OF SAN FERNANDO SPECIAL EVENT – INDIGENOUS PEOPLES DAY PERMIT. Attached a valid City of San Fernando Special Event permit to the Vendor Package.

Food vendor is required to have a current Los Angeles County health permit and provide a total of $100 in meals over the course of the event to feed the Event Head Staff. Fees.
All Fees are due at the time of submitting Vendor Package. Deadline for all applications is September 29, 2017. Fees are non-refundable, except in cases where IPD Host is unable to deliver possession of the Premises or hold the scheduled Indigenous Peoples Day, or if cancellation is given in writing 90 days prior to start date of the Indigenous Peoples Day.
No personal checks accepted; only Cashier’s Check, Money Order or Charge Card will be accept.

Promotion and Sale of Products.
All Artisans and Vendors please note: The IPD Host requires you to be in compliance with the Indian Arts and Crafts Act of 1990 (P.L. 101-644), which prohibits misrepresentation in marketing of Indian Arts and Crafts products within the United States. Vendor’s application, which is attached hereto and incorporated herein in its entirety, must list the Products Vendor intends to sell and such Products must be approved by IPD Host. Non Native American products must also be listed and approved by the IPD Host and must be properly labeled at the time they are put on display for sale. Vendor applications must be submitted by no later then September 29, 2017 to ensure a reserved space. Please contact us as soon as possible if you are unable to meet this deadline.
Vendor Space.
The Vendor space location and costs shall be as set forth in the Vendor Application or as established by IPD Host. Electrical service shall be available as set forth in the Vendor Application. The specific location of Vendor’s space shall be determined by IPD Host, will provided by October 7, 2017, and is subject to change at any time. Space prices increase if payment is received after August 25. 2017.
Clean Up.
Vendor is responsible for the cleanliness of Vendor’s assigned space during the Indigenous Peoples Day and must keep the space clean and presentable at all times during the Indigenous Peoples Day. Trash will be collected in designated areas. Food Vendor shall not spill cooking liquids, eg. oil, grease, etc. Vendor must leave space in a clean state when departing the Premises or Vendor will be assessed a clean-up fee of up to $150.
Move In/Out.
Vendor shall not move personnel, equipment, Products or materials into the Premises prior to 7:00 a.m. on October 14, 2017, unless written approval for earlier use is granted by IPD Host. The Vendor shall remove from the Premises, all property, goods, and effects belonging to Vendor by 8:00 p.m. on October 14, 2017. If such property is not removed from the Premises at the conclusion of the Indigenous Peoples Day, IPD Host may store any property and Vendor shall pay a reasonable fee for such storage and all expenses incurred therefor. If the stored property is not claimed and storage fees are not paid within ten (10) days of being notified by IPD Host, the property shall be deemed abandoned and IPD Host shall then have the right to sell or otherwise dispose of the property, goods, or effects in such a manner as is permitted by law and to apply the proceeds thereof toward any and all charges incurred by IPD Host.
All food vendors must have adequate flooring to protect Premises, you can check your input here. Vendor acknowledges that there are NO staking the Premises grounds and motor vehicles are NOT allow onto the Premises grounds.
Conduct.
Vendor hereby assumes full responsibility for the character, acts, and the conduct of all of Vendor’s employees, agents, contractors, representatives, patrons, guests or invitees admitted to the Premises.
IPD Host reserves the right to eject any person or persons from the Premises at any time and for any reason. Vendor hereby waives any and all rights and claims for damages, including but not limited to claims for lost profits, as a result of IPD Host exercising this right.
Indemnification.
Vendor agrees to indemnify, defend (at IPD Host’s option), and hold harmless IPD Host, its officials, officers, agents, sponsors, business entities, and employees, collectively hereinafter referred to as “Indemnified Parties”, from and against all claims, demands, defense costs, liability, expenses, reasonable attorney fees, or damages of any kind or nature arising out of or in connection with Vendor’s use or occupancy of the Premises, or arising out of any act or omission of Vendor or any of Vendor’s employees, agents, contractors, representatives, patrons, guests or invitees; excepting such claims, demands, defense costs, liability, expenses, or damages arising out of the gross negligence or willful misconduct of one or more of the Indemnified Parties.
Notwithstanding the provisions of the above paragraph, Vendor further agrees to assume all risk, and to indemnify, defend and hold harmless the Indemnified Parties from and against all claims, demands, defense costs, liability, expenses, or damages of any kind or nature arising out of or in connection with damage to or loss of any property belonging to Vendor or Vendor’s employees, exhibitors, contractors, representatives, patrons, guests, or invitees.
Vendor further agrees to indemnify the IPD Host for damage to or loss of Premises property arising out of or in connection with Vendor’s use or occupancy of the Premises, or arising out of any act or omission of Vendor or any of Vendor’s employees, agents, contractors, representatives, patrons, guests or invitees; excepting such damage or loss arising out of the gross negligence or willful misconduct of the Indemnified Parties.
Liability.
Nothing herein contained shall be construed as limiting in any way the extent to which Vendor may be held responsible for damages to persons or property resulting from Vendor’s or Vendor’s employees, agents, contractors, representatives, patrons, guests or invitees use and occupancy of the Premises, or Vendor’s obligation under this Agreement.
Use of Image.
Vendor agrees that the IPD Host and their agents, contractors and representatives, have the exclusive right to use video and other visual/audio portrayals of Vendor or Vendor’s likeness taken during the Indigenous Peoples Day in any medium of any nature whatsoever for any purpose, including the right to modify the image, in perpetuity including advertising or promoting the services of the Fernandeño Tataviam Band of Mission Indians (Tribe) and Pukúu Cultural Community Services without any compensation being paid to Vendor and without any notice or approval. Any such portrayal or likeness shall be the exclusive property of the IPD Host.
